Based on information published on the website for the Bureau of Indian Affairs you are the ICWA Director at the Choctaw Nation of Oklahoma. Please let me know if this is not accurate. I want to inform you that the law is NOT being followed in Amanda Mulanax's DHS case. Amanda has had no contact with her children since October 2022. Oklahoma DHS removed Amanda's four children in October 2022 and there was NO JUST CAUSE for removal. The Indian Child Welfare Act of 1978 was recently upheld by the Supreme Court in June 2023. The Indian Child Welfare Act mentions that state agencies like Oklahoma DHS must make "active efforts" to keep Native American children with their families. And if removal becomes necessary, the agency must make "active efforts" to reunite Native American children with their families. Oklahoma DHS is NOT following the law in this way. Please review Amanda Mulanax's cases for ALL FOUR of her minor children: Amanda Mulanax wants her attorney to file a motion to invalidate the custody proceedings based on noncompliance with ICWA. I am concerned that Amanda's appointed attorney is intentionally withholding documents when requested and failing to file motions that would help reunify Amanda's family. Amanda is having trouble obtaining documentation regarding the removal of her children even though she requested the documents from a supervisor at DHS whose name is James Andrew Jarvis. Based on said supervisor's LinkedIn profile, the supervisor is on a "newly formed unit" at DHS "with the goal of adoption as the focus." The supervisor's goal to permanently dismantle families violates Federal Law when applied to Amanda Mulanax's case. Amanda Mulanax is a Native American woman and a member of the Choctaw Nation of Oklahoma therefore, Amanda's children are protected by the Indian Child Welfare Act of 1978 and ACTIVE EFFORTS must be made to reunite ALL of her children with her. No active efforts have been made to reunite this Indian family. In fact, efforts are being made by JAMES ANDREW JARVIS (supervisor at DHS) to terminate Amanda Mulanax's parental rights without just cause. Thank you for taking the time to consider this matter. Please forward this message to any and all people who can assist in rectifying this egregious violation of the Indian Child Welfare Act of 1978.
