1 Brain Injury Insider Episode 134: NYC Law Would Mandate Brain Injury Screening for Domestic Violence Survivors 3:00
Today, I would like to spotlight an important new legislative proposal being considered by the New York City Council highlighting the link between domestic violence and brain injury and the need for screening of domestic violence survivors for this invisible injury. The legislation would require mandatory screening for brain injury among survivors of domestic violence whose injuries often go unrecognized and unsupported. Today, I would like to discuss the tragic midtown Manhattan shooting on July 28, 2025, in which the shooter—Shane Devon Tamura, a 27‑year‑old former high school football player left a suicide note claiming he suffered from CTE, or chronic traumatic encephalopathy, and blamed the NFL for concealing the dangers of football. He asked for his brain to be studied post‑mortem. Tamura never played in the NFL—he only played in high school—and there’s conflicting information regarding a history of head trauma or concussions. CTE can only be diagnosed via autopsy. CTE is a degenerative brain disease marked by abnormal tau protein build‑up. Symptoms typically appear years after repeated head impacts including memory loss, confusion, mood swings, depression, aggression, and suicidal thoughts. CTE is not exclusive to football. Repetitive sub concussive hits—or those without obvious symptoms—can be harmful. It affects not only professional athletes but also high school and college players, as well as athletes in hockey, boxing, soccer, rugby, and even military veterans. Repetitive head trauma, early exposure to head trauma and concussions, or even repetitive head trauma—especially when not fully recovered from—pose serious risks, even at amateur levels, and can contribute to the development of CTE. Athletes, coaches, parents, and officials need to be educated to recognize the symptoms of a concussion including headaches, confusion, dizziness, sensitivity to light/sound, and emotional changes. If there’s any suspicion of a concussion—“when in doubt, keep them out”. No matter the level or sport. Slow, conservative return‑to‑play protocols must be enforced; rest and medical clearance should be required before resuming activity. My partner Shana De Caro and I opposed the NFL settlement before the Court of Appeals and the United States Supreme Court. We showed the NFL settlement failed to compensate the vast majority of players who suffered the effects of repetitive head trauma. Discussing CTE we informed the Court, the existing NFL concussion settlement placed an unfair deadline: only players diagnosed with CTE by a certain date could qualify. That excluded many who developed symptoms later in life and were confirmed only after the cut‑off. Players who were posthumously diagnosed after the settlement deadline could not take part —and were left without support or compensation This tragedy underscores the need to reconsider how eligibility criteria are structured, what support exists for later‑onset cases, and how funding must follow the science—not arbitrary time limits.” We mourn all the victims of this shooting. Tamura’s beliefs—and the mental health crisis he endured—highlight that unresolved trauma, isolation, and untreated symptoms can spiral into tragedy. But whether or not he actually had CTE, this incident shines a harsh light on the broader consequences of repetitive head injuries across sports. It’s summertime and today we’re taking a hard look at a fast-growing threat to public safety—electric scooters and e-bikes. They may be convenient, but they’re causing chaos on our streets—and most people aren’t even aware of the risks. According to a recent article in USA Today, the statistics are alarming. Emergency rooms are reporting a spike in injuries, particularly head trauma and traumatic brain injury. As one trauma surgeon told USA Today, 'We're seeing people come in with fractured skulls, concussions, and brain bleeds—just from what looked like a simple fall.' And these aren't just riders. Pedestrians—elderly individuals, children, people with disabilities—are being struck or tripping over carelessly discarded scooters. In this special episode of The Brain Injury Insider, brain injury attorney Michael Kaplen highlights groundbreaking research from the University of Georgia that could change how we treat traumatic brain injury (TBI). Researchers have developed an experimental drug—CMX-2043—that may help the brain heal itself after trauma by boosting the brain’s antioxidant defenses. Early findings using a swine model show promise in reducing brain damage post-injury. This episode explores the importance of this research, the current lack of FDA-approved drugs for TBI treatment, and why continued funding for brain injury research is critical. Today, we celebrate the 4th of July—a day of fireworks, festivities, and the founding ideals of freedom and independence. I want to pause, and reflect on what independence really means, especially for survivors of traumatic brain injury. For many of us, July 4th is about barbeques, family gatherings, and patriotic pride. But for millions of Americans living with a brain injury, independence is not a guarantee. It’s a daily struggle. A journey. And often, a battle—to reclaim memory, mobility, clarity, or simply the ability to participate in life as they once did. 1 Brain Injury Insider Episode 129: Federal Budget Cuts Threaten Brain Injury Research & Programs 3:19
Brain Injury Doesn’t Have an End Date, and Neither Should Federal Funding The proposed federal budget request to Congress eliminates federal funding for critical traumatic brain injury research and education programs. The proposal includes eliminating funding for the Centers for Disease Control and Prevention, the umbrella agency responsible for TBI research, including the $8.25 million marked for brain injury research and public education about the dangers of concussions. 1 Brain Injury Insider Episode 128: TBI in Police Officers: Alarming New Study Reveals Hidden Risk 3:11
Police officers are more than twice as likely to sustain traumatic brain injuries as compared to the general population according to a new study published in the Journal of Head Trauma. The study surveyed over 600 police officers in the United Kingdon and found that 38 percent had suffered at least one traumatic brain injury compared to 12 percent of the general population. This is the largest survey to assess the relationship between TBI and law enforcement personnel. Visit our new Brain Injury Help hub at https://brainlaw.com/brain-injuries/help/ Watch this episode on YouTube at https://youtu.be/DvmvJxGP69k How much head trauma is too much? Researchers at the University of Rochester Medical Center are seeking answers in a groundbreaking new study aimed at identifying the cumulative effects of repetitive head impacts—even those that don’t cause immediate symptoms. Athletes in contact sports like football and soccer may endure dozens of head hits in a season. Even without a concussion, each hit may contribute to long-term brain damage. 🧠 Key Highlights from the Research: Special mouthguards worn during games & practice will record the number and force of head impacts. Blood plasma tests, blink reflex measurements, EEGs, and reaction time analysis will help detect subtle neurological changes. The goal: Identify biomarkers and neurological patterns that indicate early signs of brain damage—even when athletes feel “fine.” Led by Dr. Jeffery Bazarian, Professor of Emergency Medicine and Neurology, this multi-university effort could transform how we prevent, diagnose, and treat brain injury—not just in athletes, but also in military service members exposed to repeated head trauma. 📢 This research could help define a critical threshold for brain safety. 💬 Should sports organizations do more to monitor sub-concussive impacts? Let us know in the comments. 👍 Like, Subscribe, and Share to help raise awareness of this important study and its implications for sports safety and public health. #BrainInjuryAwareness #TBI #FootballInjuries #HeadTrauma #ConcussionResearch #AthleteHealth #Neurology #EEG #SportsMedicine #BrainDamage #YouthSports #SubconcussiveHits #MilitaryBrainInjury #SportsSafety #UniversityOfRochester Brain Injury Insider is a weekly podcast by The Brain Injury Law Firm ®, De Caro & Kaplen, LLP. 1 Brain Injury Insider Episode 126: Harris Poll Reveals Most Americans Still Misunderstand Brain Injury 6:03
The Harris organization polled over 2,000 American adults on behalf of The Brain Injury Association of America to determine their awareness of brain injury symptoms, causes, and key myths and facts as well as their personal experiences with brain injury. Many of the poll’s findings raise significant concerns about public awareness of brain injury and misconceptions which need to be considered and addressed by all professionals who interact with brain injury survivors. March is again designated as Brain Injury Awareness Month. Led by the Brain Injury Association of America, this year’s campaign is focused on the individual. Dated research reports every year, at least 2.8 million people sustain a traumatic brain injury, and over 5.3 million Americans are living with brain injury-related disabilities. The CDC reports that every 9 seconds, someone in the United States will sustain a brain injury. A concussion is a brain injury. So, these statistics vastly underestimate the number of individuals who sustain brain injury each year and the number of individuals suffering the lifelong consequences of a brain injury. This year’s awareness campaign is entitled, My Brain Injury Journey, focusing on significant issues that impact the lives of individuals who have sustained brain damage. 1 Brain Injury Insider Episode 123: Can Concussions And Repetitive Head Trauma Lead To Neurodegenerative Disease? 2:16
New research from Tuft’s University suggests that concussions and repetitive head trauma may reactive dormant viruses in the brain triggering neurodegenerative diseases such as Alzheimer’s Disease and Parkinson’s Disease. The study examined the Herpes Simplex Virus found in the brains of a high proportion of elderly individuals. The research found the dormant virus can be reactivated by repetitive head trauma mimicking the forces necessary to generate a concussion. The brains were then re-examined and found to have markers of neurodegeneration. Our armed service members will get some more protection under the National Defense Reauthorization Act passed by Congress in the closing days of 2024. Weapons must be changed to reduce blast exposure to troops operating these weapons and those in close proximity. Development of future weapon systems must consider brain safety. Brain injury caused by the sound waves produced during a blast continues to plague our service members. Amid a growing body of evidence of injuries and devastating symptoms caused by enemy attacks and from routine military activities, Congress and the Department of Defense need to take brain injury our service members seriously. The signature wound of military service needs to be addressed. This involves more than weapons change. It must include proper screening including tracking brain injury health and cognitive issues throughout a member’s career, expanded TBI treatment and follow up programs both before and after discharge. The increased risk of stroke following any type of traumatic brain injury is well known. A new comprehensive review of the medical literature in an article entitled Risk of Stroke After a Traumatic Brain Injury, a systematic review and meta-analysis published in the ACTA Neurological Journal this November, confirms this link. Traumatic brain injury is a leading cause of death and disability in the United States and is associated with increased risk of neurological disorders including seizure disorders, Parkinson’s Disease, ALS, dementia, and Alzheimer’s disease. This comprehensive literature review confirms the relationship between traumatic brain injury and stroke. The review found across the spectrum of all types of TBI, mild, moderate, and severe, patients were at an increased risk of both ischemic strokes caused by a blood clot in the brain and hemorrhagic stroke caused by bleeding within the brain. This risk of stroke is at the highest levels in the first three months following any traumatic brain injury pointing to the need for careful monitoring of all patients suffering TBI for the signs and symptoms of stroke. Although the risk then goes down, it is not eliminated, and patients still need to be monitored. In patients who may have developed a carotid or vertebral artery dissection, bleeding in an artery of the neck following neck trauma, in patients taking anti-coagulation medication, blood thinners which increases the risk of bleeding, and in the elderly, monitoring for stroke is essential following a traumatic brain injury.
